Karachi – The Sindh High Court has taken up a constitutional petition (C.P. No. D-968/2025) filed by Advocate Khadim Hussain, through his counsel Advocate Nehal Khan Lashari challenging the recent appointment of Prosecutor General Sindh on an acting charge basis. The court has granted urgency in the matter and has issued notices to the Respondents and the Advocate General Sindh, setting the next hearing for 27th March 2025.
Key Points of the Petition:
The petitioner, Advocate Khadim Hussain Lashari , has challenged the Government Notification dated 03.02.2025, which appointed Respondent No. 3 as Prosecutor General Sindh.
It is argued that the appointment violates Section 6 of the Sindh Criminal Prosecution Service Act, 2009, which mandates that the Prosecutor General must be appointed by the Cabinet.
The petition also cites the Sindh Prosecutors (Appointment and Conditions of Service) Rules, 2006, claiming that the current appointee is No. 17 on the seniority list, and several senior officers were bypassed without proper justification.
The petitioner contends that even in acting charge appointments, discretionary power must be exercised fairly, which was not done in this case.
Court’s Decision:
The Sindh High Court has granted urgency and issued notices to the Respondents and the Advocate General of Sindh.
Notices have been sent through all modes except publication to ensure an efficient legal process.
The matter has been fixed for the next hearing on 27th March 2025.
Impact & Legal Significance:
This case will determine whether the Government of Sindh followed legal procedures in making the appointment.
If the petition is upheld, the appointment may be declared illegal, setting an important precedent for future appointments in the Sindh Prosecution Service..m
