ISLAMABAD: The Supreme Court (SC) of Pakistan has issued a significant judgment in a longstanding land dispute involving four kanal and four marla property located in Golra Sharif, Islamabad, making important observations regarding the legal status of oral sale agreements.
According to the detailed written judgment, approved for reporting, the apex court emphasized that clear and reliable evidence is indispensable in property matters. The case under consideration pertained to land situated in the revenue estate of Golra Sharif.
A bench comprising Justice Shahid Bilal Hassan and Justice Shakeel Ahmad heard the case and subsequently issued the verdict. As per the case record, the land was allegedly purchased in 1980 through an oral agreement involving the appellants and other parties.
The matter reached the Supreme Court in the form of civil appeals (C.A. Nos. 2148 and 2266 of 2019) against a judgment of the Islamabad High Court dated November 21, 2019.
Counsel for both sides presented their arguments before the court. Senior lawyer Muhammad Saad Umar Bhatti represented the appellants, while Zulfiqar Ali Abbasi and others appeared on behalf of the respondents.
In its written decision, the Supreme Court thoroughly examined all aspects of the case, particularly the legal standing of oral sale and the evidentiary requirements. The court held that in such matters, strong evidence and compliance with legal formalities are essential to determine ownership rights accurately.
After reviewing the ownership claims, positions of the parties, and available record, the court issued its final order, thereby disposing of the case.
